Scope of application
These conditions of Hacienda Labs SAS (hereinafter referred to as “the seller”) apply to all sales, deliveries and services of the seller, which the customer buys from the seller via the online shop. Inclusion of conditions stipulated by the customer is rejected, unless the parties have expressly agreed otherwise.
“Customers” are both consumers and business people, whereby a consumer is any natural person who is concluding a legal transaction which cannot be primarily attributed to their commercial or independent professional activities. In contrast, a business person is any natural person, legal entity or partnership with a legal capacity that concludes a legal transaction, while undertaking a self-employed or commercial professional activity.
Conclusion of contract
By placing an order through the HLabs webshop, the customer accept the seller’s Terms and Conditions and confirm acceptance of the cancellation policy. The contract text will not be saved by the seller upon conclusion of the contract. Therefore, it is up to the customer to save the order information for future requests.
Order processing, confirmation and contact are carried out via email, with the use of an automated purchase processing software. It is therefore the responsibility of the customer to ensure that the email address provided for order processing is correct.
PRICING and discounts
All the prices indicated by the seller are subject to change without notification.
Value added tax (VAT) is shown separately, and calculated in the checkout page, depending on the country selected in the "shipping address" fields. Any additional costs for packaging and shipping will be shown separately.
Other price components, such as supplementary taxes, duties or other charges may be incurred for cross-border deliveries.
Discounts cannot be combined with any other offer or promotion.
Payment can be made as follows:
– Payment by Stripe (Stripe Payments Europe, Limited), Ireland
The customer can pay directly by credit card on the webshop by entering the information in a secure form.
It is also possible to pay directly through your browser, using either "Apple Pay" (for Safari web browser) or "Pay with browser" (for other compatible browsers such as Firefox, Chrome, Edge).
These payment methods are processed by the Stripe company.
– Payment by credit card or direct debit via PayPal (Europe) S.C.A., Luxembourg.
After placing the order, the customer will be forwarded to the PayPal site, where the customer’s payment to the seller will be made by credit card or SEPA debit, depending on customer's choice. Debiting the bank account or the credit card depends on the processing of the customer’s banks or the customer’s credit card institution. In this regard, please consider the terms & conditions of PayPal which you agreed to when you opened a customer account with PayPal. If you do not have a PayPal account, please note PayPal’s terms and conditions and processes for this.
For products available in stock, the usual delivery times are as follows:
Metropolitan France: 1-2 business days
Europe : 2-4 business days
Rest of the world : 3-7 business days
These delivery times are given as an indication only and may vary according to the period. The seller cannot be held responsible for a longer than expected delivery time, especially for deliveries outside EU where customs clearance time can be added.
RETENTION OF TITLE
The delivered goods remain the property of the seller until all claims arising from the contract have been fulfilled.
If the customer is a business person, legal entity under public law or special fund under public law, the retention of title also applies furthermore from the existing commercial relationship until all claims due to the seller with regard to the contract have been settled.
30 Days Money Back Guarantee (extended right of return)
In addition to the right of revocation within 14 days, the seller provides an extended 16 days money-back guarantee for customer for distance contracts. It is possible for the customer to return products purchased at the webshop to the seller within 30 days through return delivery for no particular reason. The time limit starts to run after the receipt of the products by the customer.
In order to use the right of return, it is necessary to return the product to the seller after making a claim. It is essential to have contacted the seller before returning the goods.
The product has to be returned to the seller in original packaging as well as in safe outer packaging, with all accessories and without any signs of usage. The seller reserves the right to apply restocking fees or to refuse a withdrawal of the products and to return the products to the customer in case of a loss in value through obvious defects through usage.
The 14-days right of revocation prescribed by law remains unaffected from these provisions.
Special or customized items can't be returned and don't apply to the 30-days money back guarantee or the 14-days right of revocation.
LANGUAGE OF THE CONTRACT
The contract languages are French and English.
The French law shall apply to this contract.
The regulations concerning UN sales law are not applicable.
If the customer is a merchant, a legal person under public law or a special fund under public law, the sole place of jurisdiction for all disputes arising from this contract shall be the registered office of the seller. The same shall apply if the customer has no general place of jurisdiction in France or in the EU, or if his domicile or habitual residence at the time of the lawsuit is filled is not known.
All customer details and data collected will not be passed on to a third party. Data will only be transferred to a third party if this is necessary for the execution of the contract. All collected customer data is stored for contractual and further informational purposes only. The customer may object to the storage of data for the purpose of sending information content at any time to the above address.
